Definitions
1.1 “Everest Protect” means Everest Protect (Pty) Ltd, registration number 2022/840317/07, an authorised Financial Services Provider (FSP No. 52980) licensed in accordance with the Financial Advisory and Intermediary Services Act, 2002.
1.2 “Digital Platform” refers to Everest Protect’s official website (https://www.everestprotect.co.za) and any associated platforms, mobile applications, or services.
1.3 “Software” means any proprietary or licensed application or web-based service owned or operated by Everest Protect.
1.4 “Personal Information” has the meaning assigned under the Protection of Personal Information Act, 4 of 2013 (POPIA), including any data used to identify a natural or juristic person.
1.5 “User” / “You” / “Your” refers to any person accessing or using the Digital Platform or interacting with Everest Protect’s services.
1.6 “Business Day” means any day other than a Saturday, Sunday, or public holiday in the Republic of South Africa.
Acceptance of Terms
2.1 By using this Digital Platform, you acknowledge and agree to be bound by these Terms and Conditions, Everest Protect’s Privacy Policy, and any supplemental policies applicable to the services used.
2.2 If you do not agree to these Terms, you must immediately cease all access to the Digital Platform and related services.

3.1 Use of the Digital Platform is granted on a limited, revocable, non-exclusive, and non-transferable basis for lawful purposes.
3.2 You agree not to use the Digital Platform to:

- Interfere with or disrupt the platform’s functionality;
- Access unauthorised areas or data.
3.3 Everest Protect reserves the right to suspend or terminate your access without notice for any breach of these Terms.

4.2 All insurance quotes and products are subject to underwriting, terms and exclusions. Final cover is confirmed only on acceptance by the insurer.
4.3 You must consult a licensed financial advisor before making any financial decisions based on information provided by Everest Protect.

5.1 This Digital Platform may include links or tools operated by third parties. Everest Protect has no control over these and accepts no liability for their content or performance.
5.2 Use of third-party links is entirely at your own risk.
Privacy and POPIA Compliance
6.1 Everest Protect collects and processes your Personal Information lawfully and transparently, solely for the purposes related to our services.
6.2 You have the right to access, correct, or request deletion of your Personal Information as prescribed under POPIA.
6.3 Everest Protect implements technical and organizational safeguards to protect your data but cannot guarantee absolute security.
Cookies and Tracking Technologies
7.1 The Digital Platform may use cookies to enhance functionality and user experience. By continuing to use this site, you consent to our use of cookies in line with our Cookie Policy.
Intellectual Property
8.1 All content, trademarks, logos, data, software, and multimedia on the Digital Platform are the property of Everest Protect or its licensors.
8.2 No content may be reproduced, distributed, or modified without Everest Protect’s prior written consent.
Communications and Electronic Transactions
9.1 You agree that all agreements, disclosures, and communications sent electronically by Everest Protect satisfy legal requirements for written communication.
9.2 Everest Protect may record or monitor all electronic interactions for compliance and security purposes.
Indemnity and Limitation of Liability
10.1 You agree to indemnify Everest Protect, its directors, employees, and affiliates against any claim, loss, or damages arising from your use of the Digital Platform.
10.2 To the fullest extent permitted by law, Everest Protect shall not be liable for any direct, indirect, incidental, or consequential loss related to your use or inability to use the Digital Platform.
Regulatory Disclosures
11.1 Everest Protect (Pty) Ltd is a registered Financial Services Provider, licensed by the Financial Sector Conduct Authority (FSCA).
11.2 A full list of Everest Protect’s FSP disclosures, license conditions, and complaints process is available on request or from the FSCA.
Amendments to Terms
13.1 Everest Protect reserves the right to amend these Terms at any time without prior notice. The most recent version will be available on our website.
13.2 Continued use of the Digital Platform following any amendment constitutes acceptance of the updated Terms.
Governing Law and Jurisdiction
14.1 These Terms and Conditions are governed by the laws of the Republic of South Africa.
14.2 All disputes shall be subject to the exclusive jurisdiction of the South African courts.
